Prior to registering a trademark at the registry (“RCS”),
it is necessary to conduct a precedence research with the National
Institute for Industrial Property ("INPI") to ensure
that the trademark is available, that it is not the property of a
competitor, or that it does not interfere with the previous rights
of third parties.

What should you include in your registration file ?
The trademark registration file must include five copies of the
registration request form given by the National Institute for Industrial
Property (“INPI”). The following information must be
mentioned on these application forms :
- The applicant’s identity, natural person or legal entity,
and , if applicable, his authorized agent
- The visual representation of the trademark
- A listing of all goods and services in association with which
the trademark is proposed to be used. This listing must be drafted
with great care. It will determine the range of protection from
which the trademark will benefit.
- An indication of the categories the goods and services belong
to.
- If applicable, a brief description of the trademark, and if
it is registered in color, a description of those colors.
